What is SCOMET

Dual use items having potential for use in Civilian applications as well as military applications and are capable of being deployed as Weapons of Mass Destruction (WMD) Programme are called SCOMET

1) Facilitate high-tech trade and technology transfer.
2) Global security and non proliferation.

Purpose

Export of SCOMET items is restricted. Their export is permitted only against an authorisation.

Amendment / correction of SCOMET Authorisation

May add new items, decrease the quantity of items, modify the UOM.

Revalidation

Revalidation of Authorisation extended on merits for a period of six months and maximum Upto 1 year by DGFT RA on the approval of DGFT HQ.

How to Apply

Application in ANF – 2O to DGFT alongwith prescribed documents

Documents Required

1.   Valid Digital Certificate – Class 2 for DGFT (IEC-based) purposes with password

2.   IEC copy

3.   ANF-1 (Profile of Importer and Exporter)

4.   ANF- 2O (Previous Authorisation Copy if any)

5.   Contract Agreement / Purchase Order

6.   Original End User Certificate (2S (i) ) from all the firm / entities involved in the supply chain of the product(s) (to be furnished on their letter head(s) duly signed by the authorised signatory)

7.   Technical Specifications of Export item

8.   Bills of Entry for previous exports

 

End User Certificate (EUC)

 

  1. EUC is the critical document. EUC must indicate name of the item of export, name of the importer, specific end use of the product and details of Purchase Order.
  2. It is non-transferable from the state of the recipient

 

Appendix- 2S (i)

  1. Required for export of items under SCOMET Categories 2,3,4,5 & 8.
  2. Re-export in case of stocked items other than Category 1 (From Stockist to ultimate end user).

 

 

Appendix- 2S (ii)

  1. Required for items under SCOMET Category 1 (Chemicals, related software and technologies).
  2. Re-export in case of stocked items under SCOMET Category 1

 

Appendix- 2S (iii)

  1. Application for Stock and Sale* authorization (from Exporter to stockist, for all SCOMET Categories except Category 1).

 

Appendix- 2S (iv)

  1. Global Authorisation for Intra-Company Transfer (GAICT) of SCOMET items / software / technology.

 

**Note:**

 

Stock and Sale is not permitted for SCOMET Category 0, Category 3A4001, Category 6 and transfer of technology in any category.

 

Approving / Issuance

 

Inter-Ministerial Working Group (IMWG) in the DGFT under the Chairmanship of Additional Director General of Foreign Trade will consider all requests for export of SCOMET items on merits.

 

Post Complaince

MAINTENANCE OF RECORDS

 

  1. Every SCOMET authorisation holder shall maintain the following records in manual or electronic form for a period of 5 years from the date of export or import, as applicable.
  2. All documents submitted while making an application for SCOMET Authorization.
  3. Correspondence with buyer / consignee / end-user or DGFT or relevant Government agency.
  4. Relevant Contracts.
  5. Relevant Books of account.
  6. Relevant Financial records.
  7. Any communication from any government agency related to an application for authorization for any item on the SCOMET list or a commodity classification request.
  8. Shipping documents including Shipping Bill, Bill of Entry and Bill of Lading.
